A transgender man in Kentucky who was accused of sexually abusing a child entered into a plea agreement and, provided he complies with the terms of the agreement, will not go to jail.
Former daycare worker Maria Childers enlisted the help of a well-known trans activist attorney to defend him in the horrifying case.
Childers was taken into custody in February 2023 following an anonymous tip that the Department of Community Based Services (DCBS) received about an alleged abuse event that had allegedly taken place at Explore Learning Academy in November 2022.
According to the tip, which was allegedly submitted by one of Childers’ coworkers, he was accused of inappropriately handling the baby and making inappropriate remarks to it while it was being changed.
As per our research, court records detailing the full complaint against Childers showed that he was accused of both physical and sexual abuse while employed at the daycare.

Judge Joseph Roark fined Childers twelve months, but deferred sentencing and granted a six-month conditional discharge.

Witness testimony stated that Childers was asked to help a coworker change an infant’s diaper.
The coworker noted that the baby looked distressed as Childers was cleaning the baby’s genitalia and inquired as to whether Childers was injuring the child.
She then saw Childers “circularly” stroke the baby’s genitalia, stating, “That was her clit area, and she likes it.” It merely brightened her day.
Childers received a “write-up” from Academy management despite being reported.
Subsequently, the police discovered that Childers had been accused by other colleagues of neglecting the kids in high chairs for “hours.”
Upon being brought to the police station for interrogation, Childers first asserted that he had not changed the baby’s diaper throughout.
After an officer showed him a text message he had sent to the director of the daycare verifying the baby’s diaper change, he later acknowledged having done so.
Subsequently, he attempted to refute any incorrect remarks he had made, but acknowledged that he frequently made statements that were “taken out of context.”
Childers was taken into custody and accused of three counts of first-degree criminal abuse of a child under the age of twelve and one case of first-degree sexual abuse of a victim under the age of twelve.
The McCracken County Jail then received a booking for him. Although Childers was first identified as “male” by the police and the jail.
He was able to get internal documents that show the McCracken County Jail changed Childers’ gender to “female” later on.
